By accessing or using our website (kerafena.com), you agree to be bound by these Terms and Conditions, as well as any additional terms, policies, or guidelines that may apply. If you do not agree to these terms, please refrain from using the site and purchasing our products.

Changes to Terms

Kerafena reserves the right to modify, update, or replace these Terms and Conditions at any time and at our sole discretion. When we make changes, we will revise the “Last Updated” date at the top of this page. For material changes, we will make reasonable efforts to provide additional notice, such as by email to registered account holders or a notice posted on our website.

Your continued use of our website, or any purchase made after changes take effect, constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the website and refrain from placing further orders. The Terms in effect at the time you place an order will govern that order.

Eligibility & Age Requirement

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to purchase products from Kerafena or create an account. By placing an order, you represent that you meet this requirement and that all information you provide is accurate and complete.

We sell and ship only to addresses within the United States. We reserve the right to refuse service, cancel orders, or limit quantities to any person or in any geographic region at our discretion.

Account Registration & Security

Certain features of our website require you to create an account. You agree to:

Provide accurate, current, and complete information during registration and keep it updated
Maintain the confidentiality of your login credentials
Accept responsibility for all activity that occurs under your account
Notify us immediately at info@kerafena.com of any unauthorized access or suspected breach

You may not share your account credentials, allow others to access your account, or transfer your account to another person or business without our prior written consent. Kerafena is not liable for any loss or damage arising from your failure to safeguard your account.

We reserve the right to suspend or terminate any account at our discretion, including for inaccurate information, suspected fraud, or violation of these Terms.

Professional Accounts

5.1 Professional Eligibility

Access to Kerafena’s professional product line is limited to licensed cosmetologists, barbers, estheticians, and salon professionals holding a current, valid license in good standing in their state or country of practice, as well as licensed salon and distribution businesses we approve.

5.2 Verification

To obtain a professional account, you must submit your professional license number, issuing authority, expiration date, and any additional documentation we request. You authorize Kerafena to verify this information with the issuing authority or through third-party verification services, at the time of application and at any time thereafter.

You agree to notify us within 10 days if your license expires, lapses, is suspended, or is revoked. Maintaining a current license is a continuing condition of professional account access.

5.3 Approval, Suspension & Revocation

Professional account applications are reviewed manually and are not automatically approved. Kerafena reserves the sole and absolute right to approve, deny, suspend, or revoke professional account access at any time, with or without cause and with or without notice. Submission of an application creates no obligation on our part to grant access.

If your professional account is revoked or suspended, you immediately lose access to professional product listings and professional pricing, and any pending professional-tier orders may be cancelled at our discretion, with a refund of amounts paid for cancelled items.

5.4 Restrictions on Use & Resale

As a condition of professional account access, you agree that you will not:

Resell, distribute, or transfer professional products to consumers or to any person who is not a licensed professional, except as applied in the course of a professional service
List, advertise, or offer Kerafena professional products on any third-party marketplace, auction site, or e-commerce platform (including but not limited to Amazon, eBay, Walmart Marketplace, Poshmark, Mercari, TikTok Shop, or Facebook Marketplace) without our prior written authorization
Repackage, decant, relabel, dilute, or alter professional products in any way
Purchase professional products on behalf of any unlicensed individual or business
Disclose professional or wholesale pricing to consumers or competitors

Violation of this section constitutes a material breach of these Terms and may result in immediate account termination, cancellation of pending orders, and forfeiture of any discounts, credits, or program benefits.

5.5 Professional Pricing & Confidentiality

Professional pricing is offered solely to approved account holders and is confidential business information. Pricing is subject to change without notice and applies only to orders placed while your account is active and in good standing. Professional pricing does not apply retroactively to prior orders and cannot be combined with retail promotions unless expressly stated.

5.6 Independent Relationship

Nothing in these Terms creates a partnership, franchise, joint venture, agency, employment, or exclusive distribution relationship between you and Kerafena. You may not represent yourself as an agent, employee, authorized distributor, or representative of Kerafena, and you may not use Kerafena’s name or marks in a way that suggests such a relationship, without our prior written consent.

Order Acceptance, Pricing & Taxes

6.1 Order Acceptance

Your submission of an order constitutes an offer to purchase. All orders are subject to acceptance by Kerafena, and no contract is formed until we send an order confirmation or ship the products. An automated acknowledgment of receipt does not constitute acceptance.

6.2 Pricing & Taxes

Prices for products on Kerafena’s website are listed in the currency indicated on the site and may be subject to taxes depending on your location. Any applicable taxes, customs duties, or import charges are your responsibility and will be calculated at checkout or upon delivery. Kerafena reserves the right to change prices at any time without prior notice.

6.3 Errors & Order Limits

Despite our efforts, product listings may occasionally contain errors in price, description, availability, or images. Kerafena reserves the right to correct any error and to cancel, refuse, or limit any order — including orders already confirmed — where a listing error, product unavailability, suspected fraud, or suspected violation of these Terms is involved. If we cancel an order after payment, we will issue a full refund for the cancelled items.

We reserve the right to limit order quantities per customer, per household, or per order.

Shipping & Delivery

Kerafena offers shipping to locations within the United States. Shipping costs are calculated during checkout and are based on destination, product weight, and shipping method. Delivery times are estimates only and are not guaranteed. Kerafena is not responsible for delays caused by third-party carriers or customs processes.

Title and risk of loss for all products pass to you upon delivery of the products to the carrier.

You are responsible for providing a complete and accurate shipping address. Kerafena is not responsible for orders delivered to an incorrect address supplied by you, or for packages lost or stolen after confirmed delivery by the carrier.

Returns & Refunds

All sales are final. Due to the nature of our products, Kerafena does not accept returns or exchanges except as described in Section 8.1 below.

8.1 Covered Claims

We will provide a refund or replacement in the following circumstances only:

(a) Shipping damage. Your order arrived damaged in transit, and the product is unopened with all seals and tamper-evident features intact.

(b) Fulfillment error. We shipped the wrong product, the wrong quantity, or an incomplete order, and the product is unopened with all seals intact.

(c) Manufacturing defect. The product has a defect in manufacture, packaging, or labeling that was present on arrival.

For all covered claims, you must notify us at info@kerafena.com within 7 days of the delivery date, including your order number and clear photographs of the product, its labeling, and its outer shipping packaging. Claims submitted after the 7-day window cannot be honored. Please retain all original packaging until your claim is resolved, as we may be required to submit it as part of a carrier claim.

8.2 Return Authorization

Do not ship any product back to us before contacting us. We will review your claim and, if approved, issue a Return Merchandise Authorization (RMA) number along with return instructions. Products returned without an RMA number will not be accepted, refunded, or returned to you.

Where a return is required, the product must be shipped back within 7 days of the date we issue your RMA number.

Kerafena may, at our discretion, waive the return requirement and resolve an approved claim on the basis of photographic evidence alone. In that case, we will provide instructions for safe disposal of the product.

8.3 Return Shipping

Where a claim under Section 8.1 is approved, Kerafena will cover the cost of return shipping. We recommend using a trackable shipping method; Kerafena is not responsible for returns lost in transit.

8.4 Refunds & Replacements

Approved claims will be resolved by replacement or refund at Kerafena’s discretion. Refunds are issued to the original payment method within 7–10 business days of our receipt and inspection of the returned product, or within 7–10 business days of claim approval where the return requirement has been waived. Your bank or card issuer may require additional time to post the credit.

8.5 Non-Returnable

Except as described in Section 8.1, the following cannot be returned, exchanged, or refunded under any circumstances:

Any product that has been opened, used, or had its seal broken
Products damaged by misuse, improper storage, or failure to follow product instructions
Products where the customer has ordered incorrectly or changed their mind
Products purchased as clearance, final sale, sample, or promotional sizes
Gift cards

Product Safety & Proper Use

9.1 Professional Use Only

Products designated as professional are formulated for use by licensed cosmetologists and salon professionals who have been trained in the application of chemical hair smoothing and straightening systems. These products are not intended for consumer or at-home use. By purchasing professional products, you represent that you are qualified to use them and will do so in a professional setting with appropriate equipment and precautions.

9.2 Patch Testing

A patch test should be performed at least 48 hours before every application, on every client, including clients who have used the product previously. Sensitivity can develop at any time. Failure to perform a patch test is at your own risk, and Kerafena assumes no liability for reactions in cases where no patch test was performed.

9.3 Instructions & Ventilation

All Kerafena products must be used strictly in accordance with the instructions, warnings, and safety information supplied with the product and in the applicable Safety Data Sheet (SDS). Professional smoothing applications require adequate ventilation and may require personal protective equipment, including gloves and eye protection. You are responsible for maintaining a workspace that complies with all applicable occupational health and safety requirements, including any ventilation, exposure-monitoring, and hazard-communication obligations in your jurisdiction.

9.4 Allergies & Sensitivities

Our products may contain ingredients that cause allergic reactions or skin, eye, or respiratory irritation in some individuals. Review the full ingredient list before use. Do not use on irritated, broken, or compromised skin or scalp. Discontinue use immediately and seek medical attention if irritation, burning, blistering, or difficulty breathing occurs.

Nothing on our website constitutes medical advice. If you or your client has a known sensitivity, skin condition, respiratory condition, or is pregnant or nursing, consult a physician before use.

9.5 Results

Hair type, texture, porosity, prior chemical treatments, color history, and application technique all affect outcomes. Kerafena makes no guarantee regarding specific results, duration of results, or suitability for any particular hair type. Before-and-after images and testimonials on our website reflect individual outcomes and are not a promise of comparable results.

9.6 Client Responsibility

If you are a professional applying Kerafena products to clients, you are solely responsible for consulting with your client, conducting appropriate patch tests and strand tests, disclosing product information and risks, obtaining any consent your jurisdiction or insurer requires, and performing the service competently. Kerafena has no relationship with, and assumes no liability toward, your clients.

9.7 Regulatory Compliance

You are responsible for ensuring that your use of Kerafena products complies with all laws and regulations applicable to your practice and location, including cosmetology licensing rules, workplace safety requirements, and any state or local restrictions on chemical smoothing services.

Disclaimer of Warranties

EXCEPT AS EXPRESSLY STATED IN THESE TERMS, ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. KERAFENA SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that our website will be uninterrupted, secure, or error-free, or that product descriptions, ingredient listings, or other content are accurate, complete, current, or error-free.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. This section does not limit any non-excludable rights you may have under applicable consumer protection law.

Limitation of Liability

Kerafena shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising from the use or inability to use our products, website, or services, including lost profits, lost revenue, loss of business, or loss of goodwill, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount paid by you for the product that caused the damage.

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you in full. Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law. If any limitation in this section is found unenforceable, our liability shall be limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Kerafena and its officers, directors, employees, agents, and suppliers from any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

Your breach of these Terms
Your violation of any law or the rights of any third party
Your use, application, resale, or distribution of Kerafena products
Any claim brought by a client or third party arising from your application of Kerafena products, including claims of injury, damage, or unsatisfactory results
Any misrepresentation regarding your professional license or eligibility for a professional account

This obligation survives termination of your account and these Terms.

Intellectual Property

All content on our website — including text, graphics, logos, product images, formulations, packaging design, videos, and the KERAFENA name and marks — is the property of Kerafena or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, publish, or create derivative works from any of our content without our prior written permission. Approved professional account holders may use product images and approved marketing materials solely to promote Kerafena products they carry, provided such use is accurate and not modified in a way that misrepresents the brand. This limited permission may be revoked at any time.

Prohibited Uses

You may not use our website or products to:

Violate any applicable law or regulation
Purchase products for unauthorized resale or distribution
Misrepresent your identity, licensure, or professional status
Engage in fraudulent transactions or payment fraud
Interfere with, disrupt, probe, or attempt to gain unauthorized access to the website, servers, or other users’ accounts
Use automated systems, bots, or scrapers to access, monitor, or copy website content, including professional product listings or pricing
Attempt to circumvent access restrictions on professional product listings or pricing
Transmit viruses, malicious code, or any material designed to damage or impair the website

Privacy

Your use of our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference and describes how we collect, use, and protect your information. Professional applicants should note that we collect and verify professional license information as part of the account approval process.

Electronic Communications & SMS

By creating an account or placing an order, you consent to receive transactional communications from us electronically, including emails and text messages regarding your orders, shipping, marketing and account. You agree that electronic communications satisfy any legal requirement that communications be in writing.

You may unsubscribe at any time using the link in any email or by replying STOP to any text message. Message and data rates may apply. Message frequency varies.

Termination

We may suspend or terminate your access to our website, your account, or any professional-tier privileges at any time, with or without cause and with or without notice, including for breach of these Terms.

Upon termination, your right to access the website and any gated content ceases immediately. Sections relating to intellectual property, disclaimer of warranties, limitation of liability, indemnification, and governing law survive termination.

Governing Law & Venue

These Terms are governed by the laws of the State of South Carolina, without regard to its conflict of law principles.

You agree that any dispute arising from or relating to these Terms, your use of our website, or your purchase or use of our products shall be brought exclusively in the state or federal courts located in Greenville County, South Carolina, and you consent to the personal jurisdiction of those courts.

Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Our failure to enforce any provision of these Terms shall not be construed as a waiver of that provision or of our right to enforce it at a later time.

20. Authorized Sellers

Company warranties and product guarantees apply only to Goods purchased directly from Company through the Service or from an authorized distributor or salon professional. Company does not authorize the sale of its products through unauthorized retailers, online marketplaces, or resellers. Goods obtained from unauthorized sources may be expired, counterfeit, diverted, tampered with, or improperly stored, and Company makes no representation or warranty of any kind as to such Goods and disclaims all liability arising from their purchase or use. Company is under no obligation to honor returns, refunds, or replacements for Goods not purchased through an authorized channel.
